    Information on the controllers and on the rights of the person whose personal data is processed:

    Port of Gdynia Authority S.A. with its registered office in Gdynia (81-337) at ul. Rotterdamska 9 (also referred to as: "ZMPG S.A.") processes data contained in offers or requests to participate in public procurement proceedings, contained in publicly accessible registers (National Court Register, Central Registration and Information on Business of Poland, National Criminal Register), in order to conduct public procurement proceedings under the provisions of the Act of 29 January 2004. Public Procurement Law (hereinafter referred to as "PPL"). This information may include data which pursuant to Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "GDPR"), are personal data..

    In the light of the above, ZMPG S.A. informs that:

    1. The personal data administrator (later referred to as the “Controller”) is Zarząd Morskiego Portu Gdynia S.A. with its seat at Gdynia (81-337), ul. Rotterdamska 9, entered in the Register of Entrepreneurs kept by the District Court for Gdańsk-Północ in Gdańsk, 8th Commercial Department of the National Court Register under KRS number: 0000082699, holding the NIP no.: 958-13-23-524 and REGON no.: 191920577.
    2. You can contact the Data Protection Inspector in writing to the Controller's address (IOD PGA S.A. ul. Rotterdamska 9, 81-337 Gdynia) or by e-mail to the e-mail address: iod@port.gdynia.
    3. Personal data contained in offers is processed on the basis of art.6 sec. 1 letter c of the GDPR due to the fact that processing is necessary to fulfill the legal obligation incumbent on the Controller. The purpose of personal data processing is to conduct public procurement proceedings by ZMPG S.A..
    4. Providing your personal data is a statutory requirement. You are obliged to provide them, and failure to provide personal data will result in an inability to evaluate offers and conclude an agreement.
    5. Your personal data will be retained, in accordance with art. 97 sec. 1 of the PPL, for a period of 4 years from the date of completion of the public procurement procedure, and if the duration of the agreement exceeds 4 years - for the entire duration of the agreement.
    6. Odbiorcami Pani/Pana danych osobowych będą osoby lub podmioty, którym udostępniona zostanie dokumentacja postępowania przetargowego w oparciu o art. 8 oraz art. 96 ust. 3 PZP lub w oparciu o art. 2 ust. 2 ustawy z dnia 6 września 2001 r. o dostępie do informacji publicznej. Ponadto Pani/Pana dane będą przetwarzane przez Logintrade S.A. z siedzibą we Wrocławiu (54-203) przy ul. Braniborskiej 2/10 (posiadająca numer KRS: 0000438056) oraz LT Serwis sp. z o.o. z siedzibą w Warszawie (00-644) przy ul. Polnej 48 /11 (posiadająca numer KRS: 0000311815) w zakresie w jakim jest to niezbędne do obsługi Platformy Zakupowej znajdującej się na stronie: https://port-gdynia.logintrade.net.
    7. The Controller does not intend to transfer personal data to a third country or an international organization.
    8. The data you provided will not be subject to profiling.
    9. You have the right to access your personal data (art. 15 of the GDPR), the right to rectify them (art. 16 of the GDPR), the right to demand from the controller to restrict the processing of personal data (art. 18 sec 1 and 2 of the GDPR) and the right to file a complaint to the President of the Personal Data Protection Office, if you consider that the processing of your personal data violates the provisions of the GDPR.
    10. However, you do not have the right to demand the removal of personal data (art. 17 sec. 3 letter B of the GDPR), or their transfer pursuant to the art. 20 of the GDPR or the right to object to their processing pursuant to the sentence of the art. 21 sec. 1 sent. 1 of the GDPR.
